1. About Nawaya

These Terms of Use (“Terms”) govern your access to and use of the Nawaya website, platform, and services (collectively, the “Service”). Nawaya is a digital personal growth platform offering tools for reflection, journaling, learning, and interaction.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. User Accounts

By submitting User Content, you grant Nawaya a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, and use your User Content solely as necessary to operate, provide, maintain, secure, and improve the Service, and to comply with legal obligations.

You represent and warrant that you have all rights necessary to submit the User Content and that your User Content does not violate law or infringe any third-party rights.

5. Acceptable Use

  • Use the Service for lawful purposes only.
  • Do not harass, threaten, abuse, or harm other users, or encourage others to do so.
  • Do not upload or share content that is illegal, defamatory, hateful, sexually exploitative, or otherwise harmful.
  • Do not upload content that infringes intellectual property or privacy rights of others.
  • Do not attempt to access, probe, or disrupt the Service, systems, or networks without authorization.
  • Do not use bots, scrapers, or automated tools to access the Service in a way that burdens or interferes with normal operation.

6. Intellectual Property

The Service, including all software, designs, branding, trademarks, logos, and content provided by Nawaya, is owned by Nawaya, Inc. or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service or Nawaya’s intellectual property.

You may not copy, modify, distribute, sell, or lease any part of the Service unless expressly authorized by Nawaya in writing.

7. Subscriptions & Payments

The Service may include paid features, subscriptions, programs, or sessions. Pricing, billing frequency, and included features will be shown at checkout or on the relevant purchase page. Payments are processed by third-party payment providers (such as Stripe), and your payment information is handled by those providers in accordance with their terms and privacy policies.

Unless otherwise stated at the time of purchase, fees are non-refundable except where required by applicable law. If you believe a charge is incorrect, please contact us promptly at info@nawaya.io.

We may change prices or offerings over time. Any changes will apply prospectively and will be communicated where required.

8. Disclaimer

Nawaya provides tools and experiences for personal growth, reflection, and learning. The Service is provided for informational and educational purposes only.

Nawaya does not provide medical, psychological, therapeutic, legal, or financial advice. You are solely responsible for your decisions and actions. If you believe you may be experiencing a mental health crisis or medical emergency, seek professional help immediately.

9. Limitation of Liability

To the maximum extent permitted by law, Nawaya and its directors, officers, employees, partners, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

In any event, to the maximum extent permitted by law, Nawaya’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Nawaya for the Service in the 12 months preceding the event giving rise to the claim (or USD $100 if you have not made any payments).

10. Termination

You may stop using the Service at any time. You may also request account deletion as described in our Privacy Policy.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or created risk for the Service or other users. Where feasible, we may provide notice and an opportunity to remedy the issue.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
